Government never offer anything in addition to the pay and emoluments fixed to its servants. Its a universal practice.
30% and Punishment for Illegal alteration or modification or retro fitment on vehicles in kerala are trending in social media now.
Reason is simple. The Rumor is spreading like that Government Committed to transfer 30 % of the fine amount to the officer who collected the amount as fine. That means if an officer of MVD Kerala collect One Lakh Rupees as fine he will get Rs 30000/ as commission.!
And more funny thing is that the master ( Government) is again paying commission to the servant other than the monthly emoluments on fixed rate.
Field Facts
The MVD as well as Police have started using the E Challan Facility for booking traffic offences in Kerala.
The E Challan is a Web and Mobile Based application developed by National Informatics Center (NIC) for the Central Government. Majority of the states including Kerala has implemented the program seeking the advantages of the new system. The E challan woks on the basis of Repository of offences recorded in the Data base. Only Digital Payments are allowed in E Challan protocol.
All payments are directly credited to the Treasury account of concerned Governments .
With the execution of amended provisions of the Motor Vehicles Act 1988,the Central Government re- defined the offence and penalty segment of the act and increased the compounding fees to be paid as the fine amount for the offence in lieu of prosecution of the offence.
In addition to the increase of fines, several offences are separated and individual compounding fees are prescribed for each of them. All these offences are added to the repository of offence in E Challan.
The Compounding Fee Amount for the booked offences are auto calculation mode. That amount will be displayed in the E Challan Print out along with the charges mentioned against the vehicle.
Before the implementation of the New Provisions of the Motor Vehicles Act 1988,the compounding fee amount was very low and several offences were coming under the umbrella of one penal section and the fine amount will be low.
For Example ,if modification like Silencer Changing,Handle Bar Changing,Head Light Modification,Wheel Disc Modification are the alterations made on a bike Compounding fee may vary between 1000 or 1500/ was sufficient to close the case by opting to compound instead of prosecution.
Now ,with the implementation of new act ,each alteration count as separate offence and Compounding Fees Rs 5000/- per offence will be added automatically in the E challan. That will show final compounding fees as 20000/- for the above mentioned illegal modifications.
30% promise
The Compounding Fees generated under this head will goes to the consolidated account of the State Government in which only half of the money is entitled to the state government and the rest is for Central Government.
The Government normally never offer any commission for collection of money due to the exchequer. It is the duty of the concerned officers to collect the dues and remit in the exchequer. For streamlined collection ,government issues Orders and Notification regulating the functioning of officers.
Government Never offer or pay any commission to its servants. On the other hand officers are duty bound to serve the Government.
Target Fixed
Normally targets are fixed for each category of officers for evaluating their performances. The respective department revise the target for both number of cases and compounding fees according to changing circumstances.
