Registration change to new state

As the roads of Life and  engagements are wide open without  the limits of physical boundaries of the states,  shifting from one place to another place become inevitable .

If a person wants to travel beyond the state limits, in his own private vehicle, absolutely there are no restrictions..

Because  such roaming's are temporary in nature. 

But permanent shifting from one state to another state is something different.

In such case the person changes his residence to a new state and wants live or take employment in the new state.

Normally the household items and vehicles are also need to be shifted to the new state.

This kind of shifting is called as something permanent shifting 

When vehicles owned and used in one state is shifted to another state  certain  legal ( RTO level ) procedures are to  completed.

The same thing is applicable when you purchase a used vehicle from one state and wants to shift to another state, where you normally resides or take employment.

The first and important thing is Remittance of Tax in the new state.

Because  Road Tax is a subject matter included in the State List and one of the major source of Revenue for the states.

The second thing is assignment of New registration mark of the new state if the vehicle is intends to to use more than 12 months. This is mandatory as per the Central Motor Vehicles Act 1988.

So in brief, while shifting a  vehicle ,registered in one state to another state, New Registration Mark of the new state is to be assigned in place of the old Number and Tax of the New States needs to be paid.

If the owner of the vehicle intends to stay at the new state below one year it is not mandatory for Assignment of the Registration Mark but Tax for the  period of One year at a rate  1 /15 of the existing rate needs to be remitted.

In such case stay shall not exceed one year in the new state.

If the stay exceeds twelve months new registration mark and tax for the remaining period is to be remitted.

Three Phases

The first phase is to obtain necessary permission, endorsed in the registration certificate for the intended transfer.

The second one is making necessary changes in the document, remittance of tax due and getting new Registration Mark in the new state.

The Third Phase getting back the  Balance TAX remitted in the First state, subject to rules.

Here the discussion is about the First phase.

Documentation and Procedures for Shifting 

The first thing to shift a vehicle to another state is to apply for the No Objection Certificate from the original registering authority.

The  Tax  and  other liabilities due to the original registering state shall be current .Other wise application will not be entertained.

In the case of One Time Tax or Life Tax paid vehicle, the Tax is current for the period of 15 years.

If the Tax ,Insurance and Pollution Certificate of the Vehicle is current, apply to the registering authority for issue of No Objection Certificate in the name of Registered Owner ,addressing the Registering Authority of the state to where the vehicle is scheduled to shift.

The application shall have a police certificate issued by the police station where you resides.

A copy of address proof at the new state also required.

The application for NOC shall be submitted in Form 28.The NOC also issued in the space provided in the Form 28.

NOC are issued in VAHAN portal, hence the authenticity of the same can be verified at any time.

The NOC  normally issued to the RTO where the applicant have permanent residence or place of business.

Once NOC is issued to one RTO all the remaining procedures shall be completed at that place.

Hence make sure that you have a valid address proof in the concerned RTO.

Police Certificate

Certificate from the police station in which the applicant normally resides is also required for issuance of NOC. This certificates shows that your vehicle not involved in criminal cases which affect transfer of vehicle from the state.

When the certificates are ready submit application through VAHAN and up load the copy of certificates and remit prescribed fees.

Obtain the print out of the application and submit them before the Registering Authority to which the online application submitted ie the authority which issued your certificate of Registration or made endorsement on it .

NOC will be issued as  normal procedure.

Conclusion

  • Any vehicle,owned or purchased in a state can be shifted to another state.
  • If the shift is permanent ,registration mark of the new state is to be obtained.
  • Tax in the new state to be paid, based on taxation Law of the new state.
  • To shift a vehicle, first obtain NOC from the RTO of the home state.
  • For getting NOC police report is mandatory in some states.
  • You are eligible for refund of Tax as per  taxation law of the home state, if NOC issued and vehicle registered in the new state.
  • For getting NOC  submit application in FORM 28 ,with duplicate copy.
  • Obtain or affix pencil print of the Chassis Number o your vehicle in the Form 28

Take the Form 28.

Place  it over the chassis number punching on your vehicle,

Rub with the pencil slightly  over the paper in the  number punched area ,so that the numbers will be traced in the paper.

Cut and paste in the Form 28.
