7lakhs plus Unsold BS IV Vehicles Due to lock down


The Ministry of Road Transport And Highways ( MoRTH) has made it clear that  vehicle complying  BS 6 standards alone will be registered in India  wef  April 2020.Un Expected Lock Down   due to COVID 19  badly hit the automotive sector.As on the date  in which Lock Down implemented  around 700,000  Two Wheeler's and 15000 Motor Cars and 12000  Commercial vehicles are remain un sold.At the same time 105,000  Two Wheeler's and 2250 Motor Cars and 2000  Commercial vehicles were sold but could not complete the registration procedure due to lock down.

History 

Few associations approached the honble Supreme court of Judicature raising the issue.The honble court after hearing the petitioner did not made any material changes in its earlier Judgment in  W P C 13029/1985  M C Mehta  V/s Union of India ,in which the court made  for stricter implementation of the BSVI Norms for vehicles registered after  Ist April ,2020. Necessary amendments in Central Motor Vehicles Rules 115 was introduced and the Central goverment issued notification for implementation of the rules.
Subsequently,in the circumstance of lock down,the manufactures and dealers lost few day  for active sale of BS 4 Vehicles.This fact was raised as  the main contention before the Honble Court in the Interim Petition filed by the parties.


Supreme Court Decisions


  • The Supreme Court allowed to complete the registration process of the vehicles sold before lock down to be completed before  30.04.2020 by the concerned authorities..
  • In the Case of Unsold vehicles, honble court allowed  the sale of 10 % of Unsold vehicles in the respective cities  where lock down lifted.
  • No registration of BS 4 vehicles will be granted in DELHI and NCR regions.
  • The honble Court also used this case an occasion to read the provision in  Sec 115 (21 ) of Central Motor Vehicles Rules 1989 as  No motor Vehicles Coming under the BS 4 shall not be registered in the country wef 01/01/2020.Exception to this reading is granted ,in the above Interim Petition.
  • The Honble Court also demanded the petitioners to  produce list of sold vehicles as well as details of  unsold Vehicles.

Registration of BS IV vehicles After Lock Down

The  manufactures are at the liberty to sell un sold, B S  IV , vehicles not beyond 10 percent of un sold vehicles.Such Vehicles may be registered.
