It is a common querry that whether  lodging of FIR is mandatory for claiming Insurance ,  in case of road accidents.
Lot of numbers of accidents are taking place in our state as well as in our country.Major share of accidents are reported to police and few are not reporting since loss  is limited to own damage or vehicles damage .Police noramlly will not lodge FIR in all the accident cases reported to them.Other wise number of recorded in each police station will be very high.The practice followed by the police is  to register FIR in case of  hurt or death or property damage or any other third party damage reported.If the extent of damage is limited to own damage  and  damage to the vehicles only normally FIR  may not be registered in the absence of specific complaints to do so.In that case police do enter the matter in to the General Diary.GD entry is sufficent for insurance claim process.

Need of FIR for Insurance Claim


In order ot avoid the chances of fake claims insurance companies prefer to file FIR in each cases and if not possible prefer GD entry.Both are solid proof for the existence of claim.Other wise fake claims will takes place.Insurance companies may settle or accept the claim even without recording of FIR or GD entry,if the  claim  appears to be genuine.To prove  the occurence of an accident ,while making claim,always make it possible to get few photographsof the incident  from the SPOT it self .It is more preferable to take the snap shots before removing the spot or altering the position after  hit  .It may be some time in the middle of road .No problem take your own time to capture the photo graphs or viedos of the scene.This will be a strong piesce of evidence to substantiate claim .
However in certain cases FIR is mandatory.
