Cancellation of Registration Certificate of a Motor Vehicle

Any Registering Authority in the country is empowered to cancel the registration Certificate a motor vehicle if it is satisfied that the condition of the said vehicle is incapable of being used on roads or its use may likely to constitute danger to other road users.For exercising this power, the concerned Registering Authority need to get inspection report of the vehicle specifying the condition of the vehicle .Personnel hearing of the  Registered Owner is also mandatory  before excising this power. Section 55 ( 3) empowers the Registering authorities to exercise this power intended  to compel the vehicle owners to keep the vehicle in road worthy condition.

Similarly any registering authority in the country is empowered to cancel the Registration Certificate if it is satisfied that the documents on the basis of which registration obtained or information given was false in material particulars,then also the Registering Authority may cancel the registration certificate after giving an opportunity of  fair hearing  the Registered Owner of the Motor Vehicle.
The registration Certificate become invalid after such cancellation and vehicle could not be used at public place thereafter.

In addition to these ,it is the duty of  the Registered owner to  intimate immediately the Original Registering Authority that the vehicle has been destroyed  or has been rendered permanently incapable to use.The registered owner shall surrender the original certificate also for cancellation.

However the Registered Owner is eligible to get Road Tax reimbursement at the rate mentioned in the Motor Vehicle Taxation schedule,subject to the age of the motor vehicle.

Duties of Registered Owner 

  • The Registered Owner of the Vehicle shall intimate the original Registering authority ,within 14 days or as early as possible,the fact that the vehicle is destroyed or incapable to use on roads.
  • He shall surrender the Original Registration Certificate before the authority.
  • The registering authority after making ,required inquiry shall cancel the Registration Certificate.
  • After this procedure ,the Registered Owner can sell the vehicle as scrap.
  • Never forget to remove the Registration Plate as well as disfigure the Chasis/Engine Number to prevent possible Re use of the Vehicle with Fabricated Documents.
  • The Registering Authority shall issue a cancellation proceedings at the end of the procedure.
