Owner ship change of vehicles

Sale and use of used vehicles are very common in our country.Lot of show rooms offer sale of used vehicles as well as exchange, with  suitable vehicles.The used vehicle market records significant number of transaction and corresponding amount of turn over  each year.With the changing nature of business and considering the volume of sales taking place in this sector, several car manufactures are also entered  with various offers for  sale as well exchange of vehicles.Now a days are manufactures are making exchanging offers to promote sale of their new product.Lot of peoples are the beneficiary of these transactions.

While  offering or accepting  such a sale or exchange few things are to be kept in mind for our safety.The first among them is change of owner ship of the vehicle.You  shall  never forget to make sure that the vehicle you have sold or exchanged is transferred  form your name to that of the purchaser.Owner ship of the vehicle or in whose name the vehicle stand registered at the time of a crime is the sole criteria to fix legal  liability of a crime.That means the person who is registered owner or in whose name the vehicle stand registered at the time  of occurrence of a crime is also an accused,unless the sale as well as transfer of possession of the vehicle is proved.

Procedures for sale of vehicle

The sale of vehicles is regulated by Central Motor Vehicles Act 1988 and rules made there under. As per a view taken by judiciary the sale of vehicle,which is a movable property is actually governed by the Transfer of property act and the Motor Vehicles Act and Rules prescribe the procedure of sale only.In this case also the person in whose name the vehicle stand registered at the point of time will be treated as the liable person.In such case the said owner may move to the court to prove that the vehicle was posesseed or enjoyed or controlled by another person and the second person is the real owner.In such case decision will be taken by the court only.

Legal Liabilities

  • Liable for all the criminal proceedings occurred or taken place at the point of time,when the person stand as the registered owner of the vehicle.
  • Liability to pay Road Tax and its arrears,
  • All other liability raised by the implementation of this act and otherwise.
